After arguing the matter for sometime, Shri Mishra seeks permission of this Court to withdraw this Petition with liberty to avail alternative remedy as provided under Order 43 Rule 1 of C.P.C., before the appropriate forum. 2.

The revision is accordingly dismissed as withdrawn with the aforesaid liberty. It is however, observed further that if an appeal is preferred within a period of 15 days from today along with an application for its condonation of delay, the concerned Court shall consider the same in accordance with law by adopting the liberal view.
