With the consent of the parties the matter is heard finally and disposed of at motion stage itself.

The grievance of the petitioner in the present writ petition is that inspite of the fact that the petitioner was initially appointed on 07.10.2014. The services of the petitioner till date has been retained as a probationer and he has still not been confirmed in service. The contention of the petitioner is that as per the Service Rules governing the petitioner, the services of the petitioner would had been automatically confirmed on his successfully completing the probation period in October, 2016 itself. Since the respondents did not confirm the services of the petitioner, he has been

repeatedly making representation, which till date has not been decided.

The counsel for the respondents however submits from the pleadings it appears that the petitioner was involved with some criminal case while in service and his services has also been placed under suspension for quit sometime and that recently the order of suspension was revoked and he has been taken back in service. As regards the aspect of confirmation is concerned, the counsel for the respondents submits that the same shall be considered in accordance with the Rules governing the field at the earliest.

Given the said contention by the counsel for the respondents, the writ petition at this juncture stands disposed of directing the respondent No.2 to take a decision, so far as the claim of the petitioner for confirmation in service is concerned at the earliest preferably within a period of 60 days from the date of receipt of the copy of this order.

With the aforesaid observations, the present writ petition stands disposed of.
