Madhoram Satnami v. Vinod Pandey
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CONT No. 829 of 2019 • Madhoram Satnami S/o Late Shri Bhoko Satnami Aged About 72 Years R/o Village Mittumuda, Raigarh District Raigarh Chhattisgarh ---- Petitioner
Versus
• Vinod Pandey Commissioner, Municipal Corporation, Raigarh District Raigarh Chhattisgarh ---- Respondents For Petitioner :
Shri Vivek Kumar Pandey, Advocate S.B.:
Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 18/10/2019 Heard.
The grievance of the petitioner, as ventilated through this contempt petition is that, though, this Court directed that along with demarcation report, the petitioner may lay his claim for payment of compensation and the Corporation shall decide the same in accordance with law, till date, petitioner's claim has not been decided by the Corporation.
2.
The records show that after the order was passed by this Court, a demarcation was carried out as per the directions of this Court and according to the petitioner, demarcation report is in favour of the petitioner showing that his land is being used by the Corporation for construction of road. 3.
The petitioner made representation on 10/05/2018 before the Corporation. In the spirit of order passed by this Court, petitioner's claim was required to be considered by the Corporation. True it is that no particular time limit was fixed but the authorities are required to comply with the order within a reasonable time and
the authority, who is under an obligation to comply with the directions, cannot sit over the order of the Court for indefinite period. 4.
The representation was made before the Corporation on 10/05/2018 and even after lapse of 11⁄2 years, the Commissioner of the Corporation is sitting over the matter without any decision. This is highly condemnable. The respondent / Commissioner must comply with the directions of this Court within 30 days from the date of receipt of copy of this order, failing which, contempt proceedings would be drawn against him.
5.
With the aforesaid observations, the contempt petition is disposed off. Sd/- ( Manindra Mohan Shrivastava ) Judge Deepti
