The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.417/2016 registered in Police Station Pathriya, District Mungeli (C.G.) for offence punishable under section 20-B of Narcotics Drugs and Psychotropic Substance Act, 1985.

As per the prosecution case, on 4/12/2016 police on a secret information received that the applicant was carrying contraband cannabis in motorcycle, on a raid being conducted 2kg of cannabis were recovered from the applicant and from the pillion rider 1200 gms of cannabis were recovered.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, seizure was not made in person from the applicant. It is submitted that charge sheet has been filed, no further investigation would be necessary and applicant is in jail since 4/12/2016, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. Considering the quantity of cannabis recovered from the applicant which is 2 kg and seizure has already been made, charge sheet has been filed, no further investigation would be necessay and applicant is in jail since 4/12/2016, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
