(2) This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.01/2016 registered at Police Station Gendatola, District Rajnandgaon for the offence punishable under Section 376 of the Indian Penal Code.
(3) The first bail application of the applicant was dismissed as withdrawn by order of this Court dated 25.04.2016 passed in M.Cr.C. No.2208/2016.
(4) After hearing learned counsel for the parties, taking into consideration the facts and circumstances of the case and the fact that ten material prosecution witnesses have already been examined before the trial Court and only six witnesses are yet to be examined, therefore, the bail application is disposed off with a direction to trial Court to expedite the trial and conclude the same expeditiously preferably within a period of three months from the date of receipt of certified copy of this order.
