Vinod Pandey v. Manjeet Singh Hura
NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR CONTEMPT PETITION (C) NO. 968 OF 2020 Vinod Pandey, S/o Shri Chandrama Prasad Pandey, aged about 41 years, R/o Mahamai Para, Purani Basti, Raipur (CG) ... Petitioner versus Manjeet Singh Hura, Manager, Laxmi Mahila Sahkari Bank Maryadit, Millennium Plaza, Complex, G.E. Road, Raipur (CG) ... Respondent For Petitioner :
Mr. C.J.K. Rao, Advocate.
Hon'ble Shri Justice P. Sam Koshy Order on Board /01/2021 1.
The present Contempt Petition seems to have been filed by the Petitioner against non-compliance of order dated 16.7.2020 passed by this Court in WPS No. 955/2011.
2.
At the outset, this Court is of the opinion that the present Contempt Petition may not be sustainable for the reason that the Petitioner herein was not the Petitioner in the said Writ Petition. He was only a beneficiary of the order passed by the Deputy Registrar, Cooperative Societies. Moreover, the challenge before the Registrar, Cooperative Societies, was the order passed by the Revisional Authority wherein the Revisional Authority has set aside the order of Registrar and has also upheld the order of the Deputy Registrar. The original order which stands affirmed while disposing of the Writ Petition was the order of the Deputy Registrar, Cooperative Societies, dated 31.7.2006, in a proceeding under Section 55(2) of the Chhattisgarh Cooperative Societies Act, 1960. If at all, if there was noncompliance of the order, appropriate proceedings have to be drawn before the concerned authority which in the instant case is the Deputy Registrar. 3.
Reserving the right of the Petitioner to approach the concerned authority for the execution of the said order, the present Contempt Petition stands dropped. 4.
Contempt Petition accordingly stands disposed of. Sd/- (P. Sam Koshy) /sharad/ JUDGE
