This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.08/2017 registered at Police Station- Lormi, District Mungeli (C.G.) for the offence punishable under Sections 381, 411, 34 of Indian Penal Code. 2.

As per the prosecution case, a theft was committed in the Punjab National Bank on 04.01.2017 and one Ramesh Singh, who was the Cleaner in the Bank has stolen Rs.20 Lakhs from the Daraj of the Cashier and thereafter fled away and during investigation, Rs. 4 Lakhs was recovered from the present applicant. 3.

Learned counsel for the applicant would submit that the coaccused Ramesh Singh is brother-in-law of the present applicant and he runs a shop and the cash amount was given to him to keep in custody and he was not aware about the fact that the same was stolen, therefore, the applicant has not committed any offence, consequently, he may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary, memorandum of the co-accused Ramesh Singh and the present applicant also. Taking into the statement and the degree of allegation against the present applicant, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Ashok
