-1NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CRMP No. 1697 of 2018 State Of Chhattisgarh Through- Police Station Farsabahar, District- Jashpur, Chhattisgarh., District : Jashpur, Chhattisgarh ---- Petitioner

Versus

Asman Ram Dhobi S/o Laxman Ram Dhobi Aged About 20 Years R/o- Village Dhobi Toli, Farsabahar, Police Station Farsabahar, District- Jashpur, Chhattisgarh., District : Jashpur, Chhattisgarh ---- Respondent For State/Petitioner : Smt. Fouzia Mirza, Addl. A.G. D.B. :Hon'ble Shri Justice Manindra Mohan Shrivastava & Ho n'ble Smt. Justice Vimla Singh Kapoor Order On Board 25/01/2021

1. Heard on prayer for grant of leave to appeal.

2. Having heard learned counsel for the State/petitioner and after perusing the records of the case, we do not find any merit in the petition because the acquittal of the accused is result of prosecutrix turning completely hostile and not supporting the case of the prosecution at all. Despite all suggestions given by the prosecution after having been declared hostile, the prosecutrix has not supported the case of prosecution and even suggestion with regard to offence alleged has been denied. Faced with this evidence, the trial Court's view to grant acquittal, does not suffer from any perversity or patent illegality so as to warrant interference by this Court.

3. The petition (CRMP) is accordingly dismissed. Sd/- Sd/- -- (Manindra Mohan Shrivastava) (Vimla Singh Kapoor)
