Learned counsel for the petitioner submits that the appeal has already been preferred before the Collector aggrieved by the impugned order which is pending before the Collector, in which, the petitioner has also moved application for stay. It is submitted that this petition has been filed because there is delay in disposal of the appeal and stay application filed before the Collector. Taking into consideration that the impugned order has been passed on 3.9.2015 and thereafter appeal has been preferred before the Collector, no relief can be granted to the petitioner at this stage.

It will be open for the petitioner to pursue the appeal and application for stay before
