1. Heard.

2. The applicant has preferred this bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.256/2020, registered at Police Station Malkharoda, District - Janjgir Champa (C.G.) for the offence punishable under Section 21 (b) of NDPS Act.

3. Applicant was found in illicit possession of 57 bottles of cough syrup contained Codeine psychotropitc substance.

4. It is argued that the present objector is the person behind applicant false implication. Objector is a witness against the

applicant in an offence under Sections 302 and 376 of the Indian Penal Code.

5. The issue of false implication will be considered at the trial stage.

6. There is nothing to doubt or the seizure of contraband from the applicant on 22-8-2020 when the concerned police raided his house on receiving secret information that applicant is in possession of huge quantity of cough syrup.

7. Learned State counsel would oppose the prayer for grant of bail.

8. Considering the entire facts situation of the case, this Court is not inclined to release him on bail. Accordingly, the bail application is dismissed, however, the trial Court is directed to expedite the trial.
