3. The Sub-Divisional Officer Revenue Saraipali, District Mahasamund Chhattisgarh.

4. The Tahsildar Saraipali District Mahasamund Chhattisgarh. --- Respondents 25.07.2019 Mr. Laxmeen Kashyap, counsel for the petitioner. Mr. Sudeep Verma, Dy.G.A., for the state.

Learned counsel for the petitioner submits that the petitioner was initially granted a part and parcel of land bearing Kh.No.71/1-2 admeasuring 0.342 hectares at village Rajadih P.H. No.35 and Rin Pustika and other documents were also issued. The said grant was made in the year 1992. Subsequently in exercise of power of review by order dated 30.10.2004 the said grant was cancelled and the petitioner was divested of the property.

Learned counsel submits that the petitioner though is in possession of the land made an application to the S.D.O. Saraipali but the same remains undecided. She submits that only the prayer made in this petition is that application which has been filed on 24.06.2019 may be decided by the S.D.O.

Taking into consideration the facts and circumstances of the case without any observation on merits, it is directed that respondent No.3 may decide the representation of the petitioner within a period

of 60 days from the date of receipt/production of copy of this order. It is made clear that this Court has not made any observation on the merits of the case.
