(2) Learned counsel appearing for the petitioner would submit that the petitioner's brother namely late Shri Ashok Kumar Katjhori died in harness on 18.12.2006 while was working on the post of Parchalak Grade-III (Line) in the respondents department. The petitioner has made an application for compassionate appointment, which is pending consideration before the competent authority and as the same has not been considered and decided till now and, therefore, a direction may be issued to respondent No.1 to decide the same expeditiously.
(3) Prayer appears to be fair and reasonable.
(4) Be that as it may, respondent No.1 is directed to consider and pass an appropriate order on application of the petitioner for compassionate appointment in accordance with law expeditiously preferably within a period of three months from the date of receipt of copy of this order.
(5) With the aforesaid observations, the writ petition stands disposed of.
(6) It is made clear that this Court has not expressed any opinion on the merits of the case and the authority concerned is free to decide the application of the petitioner in accordance with law. Sd/- (Sanjay K. Agrawal) Judge L/-
