This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.383/2016 registered at Police Station- Chhavani, District Durg (C.G.) for the offence punishable under Section 304B, 498A/34 of Indian Penal Code.

As per the prosecution case, one Rahnuma Bano committed suicide by hanging on 10.06.2016. She was married to the present applicant. It is alleged that after marriage, the applicant used to demand different amounts from different points of time from the deceased and also sold the entire gift items and subsequently again demanded Rs.1,00,000/-, therefore, she died an unnatural death within seven years of her marriage.

Learned counsel for the applicant would submit that the applicant has been falsely implicated and there was no demand of dowry.
He further submits that the charge sheet in this case has been filed and no further investigation is necessary, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perusal the case diary and the statement of Mustaq Qureshi, who is brother of the deceased. It appears that the main allegations have been attributed to the present applicant. Considering the same, I am not inclined to release the applicant on bail. 6.
Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
