This is the first bail application seeking grant of bail to the Applicant who is in jail since 13.1.2017 in connection with Crime No. 42 of 2017 registered at Police Station City Kotwali, Durg, District Durg, for the offence punishable under Sections 186, 353, 332, 294/34 of IPC. 2.

Allegation against the Applicant is that he is said to have thrown petrol bomb on the government officials who had gone to the place of incident for demolition of dilapidated structure in which the Applicant was residing. In addition, he also is said to have used abusive language and caused hindrance to the work of the government officials. 3.

Having considered the contentions put forth on either side and on perusal of record, undisputed is the fact that the premises which was being getting demolished was occupied by the present Applicant though he was not the owner of the same. The reason for the Applicant getting violent was the fact that the dwelling house of his was being demolished by the government officials. Without commenting on merits of the case, this Court

-2is of the opinion that the present is a fit case where the Applicant can be enlarged on bail.

Accordingly, the application for grant of bail is allowed. It is directed that the Applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety of the like sum to the satisfaction of the concerned Trial Court for his appearance as and when directed.
