Hon'ble Shri Justice P. Sam Koshy Order on Board 27.09.2021 .

1. The limited grievance that the petitioner has in the present writ petition is the action on the part of the respondents whereby the private respondent No.5 has been promoted from the post of Upper Division Teacher to the post of Head Master, Middle School.

2. The contention of the petitioner is that he is senior to the respondent No.5 on the post of Upper Division Teacher and therefore when the promotion process for the post of Head Master was considered, it was the claim of the petitioner which ought to have been considered ahead of the respondent No.5.

3. The petitioner at this juncture makes a limited prayer that the writ petition may be disposed of directing the respondents No.2 to 4 to take an appropriate decision on the grievance of the petitioner particularly

-2considering his seniority and his claim for promotion ahead of the respondent No.5. Accordingly, let the respondents No.2 to 4 take an appropriate decision on the representation which the petitioner has made at the earliest preferably within a period of 45 days from the date of receipt of copy of this order. In addition, the petitioner would be at liberty to make a fresh representation/objection in respect of promotion order dated 27.03.2021 to the respondents No.2 to 4.

4. The writ petition accordingly stands disposed of. Sd/- (P. Sam Koshy) Judge inder
