1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.12 of 2020, registered at Police Station Lundra, District-Surguja C.G, for the offence punishable under Section 379 of the IPC.

2. Applicant has committed theft of motorcycle belonging to complainant Ram Kailash.

3. Learned State counsel submits that the applicant has

MCRC No. 7711 of 2020 previous antecedents of involvement in two more cases, however, one of the case relates to proceedings under Section 106, 107 and 116 of the Cr.P.C. and in the other case applicant has already been released on bail by this Court in MCRC No.7704/2020.

4. Considering the fact that applicant is in jail since 21.01.2020 i.e., for more than a year; offence is triable by JMFC and also for the fact that charge sheet has already been filed, I am inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
