The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.101/2016 registered in Police Station Patan Civil and Revenue District Durg (C.G.) for offence punishable under section 294, 506-B, 323 and 307 of the Indian Penal Code.

Case of the prosecution, in brief is that on 20/07/2016 the applicant who is father-in-law of the complainant in intoxicated state assaulted the complainant on her head, cheek, abdomen and back which was enough to cause death.

Learned counsel for the applicant submits that due to family dispute the incident happened and there was no intention and the injuries were not fatal. He submits that charge sheet has been filed, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents. Considering the statement of the victim as also medical report which shows that there was

a head injury with fracture, this court is not inclined to release the applicant on bail at this stage.
