Perusal of the order-sheet of the first appeal No.97/12 shows that the first appeal has been disposed of finally on 27.01.2015, as such now no order exists/operates as on today of stay. The letter of the Fourth Additional District Judge, Bilaspur is dated 30.06.2018 reflects that the stay order was passed in first appeal on 24.08.2012, therefore, the execution was not decided however the first appeal No.97/12 has finally been disposed of on 27.01.2015. In view of this, no stay operates as such, the trial Court shall be obliged to decide the execution if not decided, within a period of three months in accordance with law.
