2. This Petition has been filed under Section 24 of the Code of Civil Procedure, 1908 by the wife seeking transfer of Civil Suit No.163-A/2021, "Yaman Kumar Choubey Vs. Smt. Mamta Sharma" pending before the Family Court Korba, District Korba to Family Court Janjgir-Champa.

According to the Petitioner, her marriage was solemnized with the Respondent on 26.06.2021 and, at the time of marriage, it was informed that the Respondent is working as the supervisor under the railway contractor at Raipur and used to earn Rs.24,000/- per month, however, it was a false information furnished at that particular time as it was revealed to the petitioner about this fact immediately after the marriage that her husband is unemployed and when she raised an objection in this regard, her husband and in-laws, started harassing her towards demand of dowry, owing to which, she started living separately in her parental house since 17.07.2021.

It is contended further by the Petitioner-wife that on 13.08.2021, her father has made an attempt of mediation between the parties, however, the Respondent has misbehaved with him, and therefore, she has been compelled to lodge the complaint against him on the said date. Further contention of her is that since she is facing financial hardship and unable to maintain herself, and therefore, she is not in a position to attend the said proceeding, pending before the Family Court at Korba, as her family members are not in a position to accompany her from Janjgir-Champa to the said Court on each and every date of hearing.

On due consideration of the aforesaid contention of the petitioner, considering further that the distance between Janjgir-Champa and Korba is only 70 to 80 Kms. and, further in absence of any material reasons assigned in the petition seeking transfer of said proceedings to the Family Court, Janjgir-Champa, I am not inclined to entertain this Petition.

6. Accordingly, the petition is dismissed.

No order as to costs.
