(2) This writ petition has been preferred seeking a direction to the respondents to rectify the petitioner's seniority in the gradation list of Assistant Sub-Inspector published on 12.05.2014 vide Annexure P/1, on

the ground that the petitioner has been posted as ASI from 27.03.2006. (3) The gradation list - Annexure P/1 itself provides in para 5 thereof that in the event any wrong or incorrect entries have been made in the gradation list, the concerned ASI shall be entitled to submit a representation before the Police Headquarter. The petitioner is thus entitled to make a representation before the competent authority. (4) Accordingly, the writ petition is disposed of with a direction that in the event, the petitioner prefers a representation seeking correction in the gradation list within a period of one month from today, the competent authority shall consider and decide the same in accordance with law, at the earliest, preferably within a period of 4 months from the date of receipt of representation.

(5) It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
