Hon'ble Shri Justice N.K. Chandravanshi Order on Board 20-101. As per applicant, this is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and no bail application is pending before any other court.

2. The applicant has been arrested in connection with Crime No. 217/2021 registered in police station Jhagarakhand, Distt. Korea, (CG) for offence punishable under Section 20(A) of the Narcotic Drugs and Psychotropic Substances Act.

3. As per prosecution story, on the basis of secret information received, police officials seized 18 plaints of cannabis from the land of ownership of the applicant, which weighs, as per case diary, 130 gm, from the possession of the applicant. On the basis of aforesaid facts, offence was registered and the applicant was arrested on 4-9-2021.

4. Counsel for the applicant argued that the applicant is innocent and has been falsely implicated in this case. He is a 62 years old person. He further submits that quantity of seized contraband is small quantity. He has no criminal antecedent. Charge sheet has been filed. Trial is likely to take some more time, therefore, he may be released on bail.

5. On the other hand, the State Counsel opposed the bail application.

6. I have heard counsel for both the parties and perused the material available.

7. Considering the facts and circumstances of the case, detention period of the applicant and quantity of seized contraband, I feel inclined to

allow the bail application. Therefore, the application is allowed. It is ordered that if the applicant furnishes one solvent surety for a sum of Rs. 25,000/- along with one personal bond of the like sum to the satisfaction of the trial Court concerned for his appearance before the concerned Court as and when directed by the said Court, he be released on bail.
