The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No.14/2017 registered in Police Station Katghora Civil and Revenue District Korba (C.G.) for offence punishable under section 306 of Indian Penal Code. 2.

As per the prosecution case, one Nandini Jaiswal committed suicide by setting herself ablaze on 12/10/2016 and she died on 19/10/2016. It is alleged that the applicant along with Jamuna Prasad used to call the deceased which was objected and the applicant being wife came and had a quarrel with her and subsequently she committed suicide.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, the applicant has not abetted any crime, charge sheet has been filed, no further investigation is necessary, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. Considering the nature of evidence collected and also dying declaration, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on her furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for her regular appearance before it as and when directed.
