The relief sought for by the petitioner in the present writ petition is for an appropriate direction to the respondents No.1 & 2 for issuance of the appointment order of the petitioner for the post of Assistant District Prosecution Officer (ADPO) in the Home Department. 2.

The contention of the petitioner is that the petitioner participated in the recruitment process for the post of ADPO. The name of the petitioner appeared in the waiting list at serial No. 1 in the scheduled tribe category and in the overall ranking the petitioner's name appeared at serial No. 16 in the waiting list.

It has been further informed by the petitioner that meanwhile, the

-2petitioner had been subjected to document verification and also undertaken the medical examination on 02.03.2019 and the report of the medical certificate was submitted before the authorities on 07.03.2019, however thereafter no order as such has been passed. The contention of the petitioner is that in the case of identically placed person, whose name appeared at serial No.1 in the unreserved category, the Department has already issued order of appointment. She further submits that in the scheduled tribe category, there is still vacancy available as one of the selected candidates has not joined on account of the selected candidate getting appointment as a Civil Judge.

Given the aforesaid facts and circumstances of the case, this Court is of the opinion that no fruitful purpose would be served rather ends of justice would meet if the respondents No.1 & 2 are directed to take an appropriate decision on the claim of the petitioner so far as the appointment to the post of ADPO is concerned. 5.

It is expected that the respondents No.1 & 2 shall take a decision at the earliest preferably within a period of 2 months from the date of receipt of the copy of this order.

With the aforesaid observations, the present writ petition stands disposed off.
