Heard on I.A. No.1/2017, application for condonation of delay in filing criminal revision.

On due consideration and for the reasons stated in the application, the application is allowed and the delay of 2 days in filing the revision is condoned.

This petition is against the interim maintenance granted to the respondent/non-applicant vide order dated 22.10.2016, passed in M.J.C. No.32/2016, by learned Family Court, Bastar at Jagdalpur, District - Bastar (C.G.).

Perusal of the order would show that interim maintenance was passed in the month of October, 2016. The parties submits that initially the application was filed in the year 2016 and in October the

Page No.2 order has been passed. As reveals that instant revision is filed on 30.01.2017.

Perusal of the order prima-facie would show that on the basis of the finding of fact, the order has been passed, therefore, at this stage, this Court is not inclined to go into merits of this case and reappreciate the fact in revision. Considering the facts I am not inclined to interfere with such finding to disturb the interim maintenance granted to the non-applicant. However, the trial Court is directed to decide the case of the petitioner within further period of six months.
