(2) Learned counsel appearing for the State/respondents submits that the impugned order dated 02.09.2016 (Annexure P-1) passed by the respondent No.3 is appealable before the competent authority.

(3) At this stage, learned counsel appearing for the petitioner

submits that the petitioner may be permitted to prefer an appeal before the competent authority within a period of 15 days from today.

(4) The prayer appears to be fair and reasonable. (5) The writ petition is accordingly disposed of with a direction to the petitioner to prefer an appeal before the competent authority. If such appeal is filed by the petitioner within a period of 15 days from today and, in turn, the competent authority shall consider and decide the same in accordance with law preferably within a period of three months from the date of receipt of appeal, after affording proper opportunity of hearing to the parties, expeditiously.
