1. Learned counsel for the petitioner would submit that the petitioner/society was earlier running a fair price shop and subsequently with the

rationalization of the policy only 500 beneficiaries were allowed in urban area. Subsequently Core PDS system was implemented wherein it was decided by the Government that the beneficiaries can avail the food grains and other articles from any shop. Learned counsel submits that therefore considering the same a communication was made by the Food Controller on 20/06/2019 by Annexure P-5, therefore the petitioner may be allowed to make a representation to the Collector (Food) which may be decided in accordance with the existing rules and scheme.

2. Considering the submission made and after perusal of the Annexure P-5 which is written by the Food Controller, Bilaspur on 20/06/2019 which purports that according to the Core PDS scheme any beneficiary can avail the goods from any shop, the petitioner is allowed to make a representation before the respondent No.3, Collector (Food) within a period of three weeks from today which may be decided according to the existing rules and scheme of the State within a period of 60 days from the date of receipt of the representation.
