(2) Learned counsel appearing for the State would submit that impugned order dated 23.07.2014 passed by respondent No.3Collector, Durg is appealable before the Commissioner, Revenue Division, Durg.
(3) At this stage, learned Senior counsel appearing for the
petitioner would submit that the petitioner may be permitted to withdraw this petition with liberty to prefer an appeal before the Commissioner, Revenue Division, Durg within a period of 30 days from today.
(4) The prayer appears to be fair and reasonable. (5) The writ petition is accordingly disposed of with a direction to the petitioner to prefer an appeal before the Commissioner, Revenue Division, Durg. If such appeal is filed by the petitioner within a period of 30 days from today and, in turn, the Commissioner, Revenue Division, Durg shall consider and decide the same in accordance with law, after affording proper opportunity of hearing to the parties expeditiously preferably within a period of three months from the date of receipt of certified copy of this order.
(6) The certified copy of the impugned order be returned to the counsel for the petitioner, after furnishing an attested photocopy thereof.
