2) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 04.11.2020 in connection with Crime No. 364/2020 for the offence punishable under Section 304 (B), 34 of IPC, register at Police Station- Basantpur, District- Rajnandgaon (C.G.).

3) At the outset, learned counsel appearing for the applicant seeks to withdraw this application.

4) Counsel for the State has no objection to the above prayer.
