Heard on application for condonation of delay in filing of acquittal appeal.

Considering the reasons assigned in the application, delay in filing the acquittal appeal of 179 days is condoned.

Heard on application for grant of leave to appeal. Perused the statement of the witness PW-1 Shamsad. Considering the same, application for grant of leave to appeal is allowed.

Registry is directed to register the case as an acquittal appeal.

Since the respondents have already appeared, therefore no further notice is required.

Respondents are directed to furnish bail bond of Rs.25,000/- and surety each in the like sum before the learned court below within a period of one month so as to ensure their appearance before this court as and when needed.

List the case for final hearing thereafter.
