1. Heard finally.
2. The applicant has preferred this application under Section 438 of the Cr.P.C. for grant of anticipatory bail as he apprehends his arrest in connection with Crime No. 47 of 2016 registered in PS Dhourpur, Distt. Sarguja for offence punishable under Section 420, 467, 34 of the IPC.
3. Learned counsel for the applicant submits that the matter is under investigation. As per allegation, being in-charge clerk of the bank, the applicant made withdrawal against rule of Rs. 24,90,780/-. The applicant is innocent. There is no material to implicate him in the offence. Hence he may be granted anticipatory bail.
4. Per contra, learned counsel for the State opposes the bail application and submits that there are material collected by the concerned police wherein as per directions of the Collector Sarguja, written FIR was registered alleging the applicant for withdrawal illegally against the rule for Rs. 24,90,780/-. The investigation is in progress. Involvement of the applicant is shown. Hence the application may be dismissed.
5. Perused the entire material.
6. On due consideration of the material collected against the present applicant, I am not inclined to grant anticipatory bail to the applicant.
7. The application is rejected.
