The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.182/2020 registered in Police Station Doundi for offence punishable under sections 363, 366, 376(2)N of Indian Penal Code and Section 5(L)/6 of the Protection of Children from Sexual Offences Act, 2012.

As per the prosecution case, on 9/12/2020 the prosecutrix along with her friend went to market where they met their uncle, thereafter went to their house wherein this applicant was present and the present applicant thereafter enticed away the girl from the lawful custody of her parents and went to Maharashtra. Subsequently, on the report when investigation was carried out, prosecutrix was recovered from Maharashtra.

Learned counsel for the applicant submits that the prosecutrix has been examined before the court and she has completely disowned the incident, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the statement, applicant is in jail since 30/12/2020, without further observation on the merit, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
