Present MCC has been filed seeking for restoration of WPT No.1684/2009 which got dismissed on a peremptory order passed by this Court on 17/05/2018.

For the reasons assigned in the application and finding them to be satisfactory, the MCC deserves to be and is accordingly allowed subject to the petitioner paying cost of Rs.10,000/- to the Middle Income Group Legal Aid Society within 7 days from the date of receipt of the certified copy of this order.

On furnishing certificate of payment of cost, the Writ Petition i.e. WPT No.1684/2009 shall stands restored to its original number with a further rider

that whatever default in the original Writ Petition (T) if any would have to be cured within a further period of 7 days.

In case if the petitioner fails to deposit the cost and produce the receipt to the registry or fails to cure the default in the original WPT within the stipulated time, the effect and operation of the order passed in the present MCC would loose its efficacy.
