1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicants, who have been arrested in connection with Crime No.06/2018, registered at Police Station Durgkondal, Distt.- North Baster Kanker for the offences punishable under Sections 420, 120-B of the I.P.C.
2. The applicants and co-accused Smt. Molina Mandal ran one N.G.O. styled as Kamdhenu Gramin Vikash Sansthan,
MCRC No. 7743 of 2020 Karramad, District- Kanker, C.G. The N.G.O. obtained possession of stray cattle and looks after their well-being by providing food, fodder and shelter. The N.G.O. received a grant of ₹62.64 Lacs from the Government between the year 2012-16, but the same was not properly utilized for taking care and fulfilling the needs of the cattle for which 46 cows expired in the year 2016. There is cheat, fraud and misuse of grant received from the Government.
3. Learned State counsel would oppose the prayer for grant of bail.
4. Co-accused Smt. Molina Mandal has already been released on regular bail in MCRC No.7145 of 2020. The present applicants are in jail since 17.09.2020; the offences are triable by JMFC and the charge sheet has already been filed, therefore, considering the entire fact situation of the case, I am inclined to release the applicants on bail.
5. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
