This is the second bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.279/2016, registered at Police Station - Kanker, District - North Bastar Kanker (C.G.) for the offence punishable under Section 20(B) of Narcotic Drugs Psychotropic Substances Act. The first bail application was dismissed on merits vide order dated 17.11.2016 in M.Cr.C. No.7192/2016.

Learned counsel for the applicant would submit that brother of the applicant is getting married on 21.02.2017, therefore, the counsel prays that the applicant may be enlarged on bail. 3.
The earlier bail rejection order shows that dismissal of the bail petition was on merit and therefore, I do not find any change of circumstances to reconsider the bail again only on the ground of marriage of the brother of the applicant.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is dismissed.
