1. The applicant has preferred this application under Section 439 of Cr.P.C. as he is in jail since 29.04.2019 in connection with Crime No.33/2019 registered at Police Station- D.D. Nagar Raipur, District Raipur, C.G. for the offence punishable under Sections 394, 120 of Indian Penal Code and under Sections 25, 27 of the Arms Act.

2. Learned counsel for the applicant submits that he does not want to prosecute this application and seeks to withdraw the same. However, he prays for grant of liberty to file bail application before the trial Court.

3. Permission granted.

4. Accordingly, the application MCRC No.7804 of 2020 is dismissed as withdrawn with the aforesaid liberty.
