1. Heard.
2. The applicant has been arrested in connection with Crime No. 52/2015 for offence Under Section 363, 366, 376 of the IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012 registered in Aarakshi Kendra Kapu, Distt. Raigarh.
3. Learned counsel for the applicant submits that the doctor treating the prosecutrix noticed no internal or external injury on her body. FIR is delayed by 7 days. The applicant is in jail since 12-4-2015 till date. The prosecutrix has been examined during trial. The applicant has a good case for grant of bail hence he may be enlarged on bail.
4. On the other hand, learned State counsel opposed the bail application.
5. Perused the material available.
6. Looking to the evidence surfaced during trial and also during investigation regarding the age and other facts, the charges framed against the applicant under Section 363, 366, 376, IPC and section 4 of the Protection of Children from Sexual Offences Act, 2012, I am not inclined to grant bail to the applicant.
7. Consequently, instant MCRC is dismissed.
