Hon'ble Shri Justice Manindra Mohan Shrivastava Hon'ble Smt. Justice Rajani Dubey Order On Board 03/04/2019 Heard on I.A.No.1/18, application for condonation of delay in filing appeal. Upon due consideration, the application is allowed. Delay is condoned.

Also heard on prayer for grant of leave to appeal. After hearing learned State counsel, perusing the impugned judgment and evidence on record and particularly the submission that there is evidence to prove that the amount which was earmarked for being allotted to each of the beneficiaries was not fully distributed, yet acquittal was ordered, we are inclined to grant leave to appeal.

Application for grant of leave to appeal is accordingly allowed. The appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.
