1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.140 of 2020, registered at Police Station Basantpur, District Balrampur- Ramanujganj, for the offence punishable under Section 224, 269, 270, 188 of the IPC and Section 3 of 51 of Epidemic Diseases Act.
2. As per the prosecution case, applicant was arrested on 13.09.2020 as he was found in illicit transport of cattle. At the time of arrest, he was sent for RTPCR test, the report of which
MCRC No. 8067 of 2020 found him COVID-19 positive, therefore, the applicant was sent for treatment and isolation. However on 15.09.2020, he ran away from quarantine center where he was kept for treatment.
3. Learned State counsel would oppose the prayer for grant of bail.
4. As informed, the applicant has already been released from jail in the offence bearing Crime No.98/2020, vide MCRC No.7674 of 2020. For the present offence which is triable by Judicial Magistrate First Class, the applicant is in jail since last more than three months and at present the applicant has already been released on parole.
5. Considering all the relevant aspects of the matter, I am inclined to release the applicant on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
