This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.97/2016 registered at Police Station- Kukdur, District Kabeerdham (C.G.) for the offence punishable under Section 420 of Indian Penal Code. 2.
As per the prosecution case, a report was made by Ram Dayal Yadav that the present applicant in order to provide agricultural lease to different persons obtained different amount from 104 villagers to the tune of Rs.6,27,900/-. Thereby, the offence has been committed.

Learned counsel for the applicant would submit that only on the oral statement, the applicant has been inculpated. He further submits that the charge sheet has been filed and no further investigation is necessary, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and statement of the witnesses. Considering the facts and circumstances of the case and the way the offence has been committed, I am not inclined to release the applicant on bail at this stage.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
