Upon due consideration, delay is condoned.

There is a prayer for grant of leave to appeal against the judgment of acquittal dated 17.12.2019 passed by the Court of the Learned Vth Additional Sessions Judge, Raigarh, District - Raigarh, C.G. in Sessions Case No.52/2017, by which, the respondent/accused is acquitted of the charges of commission of Offences under Sections 498 A and 313 of the IPC.

Taking into consideration the submission of learned State counsel that despite specific evidence led by the prosecution and the statement of the prosecutrix herself as also the evidence of the Doctor, the learned trial Court has acquitted the accused of the charges of commission of offence under Sections 498 A and 313 of the IPC, we are inclined to grant leave to

appeal. Accordingly, application for grant of leave to appeal is allowed. The appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.

Accordingly, the CRMP is disposed off.
