Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 14/02/2017 Heard on admission.

1. This petition has been filed by the petitioner for a limited relief to the extent that instead of directing the petitioner to create Fixed Deposit of Rs.2 lakh, any other security may be taken for the same amount for releasing the vehicle in favour of the petitioner by way of interim custody.

2. Learned counsel for the petitioner submits that it is difficult for the petitioner to create Fixed Deposit of Rs.2 lakh at this stage, however, the petitioner is prepared to give security of his immovable property.

3. Learned counsel for the State submits that the condition has been imposed by the Additional Collector, keeping in view the valuation of the vehicle and, creation of Fixed Deposit will not result in any serious hardship to the petitioner.

4. Having heard learned counsel for the parties, considering the overall circumstances, I am inclined to modify the order dated 24.1.2017 passed by the

-2Additional Collector, Durg to the extent it directs the petitioner to create Fixed Deposit of Rs.2 lakh and instead, it is directed that the vehicle of the petitioner may be released by taking security against any immovable property standing in the name of the petitioner with a valuation of Rs.2 lakh, to the satisfaction of the authority who has passed the order of interim custody.
