Shri Ravish Verma, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 20/10/2020 Present is an application for modification of order dated 13/10/2020 passed in MCrC No.5915/2020.

Learned counsel for the petitioner / applicant submits that while granting bail, one of the condition imposed was that the applicant will have to deposit his passport. He submits that however, the applicant is not possessed of any passport. He submits that even though this was stated before learned Court below, the Court below is not accepting the bail furnished by the applicant on the ground that the passport has not been deposited. Therefore, there is a need of modification in the bail order.

Learned State counsel submits that as the case has come up in the supplementary list, he does not have relevant papers with him. He, however, would not dispute that where the party is in a position to file an affidavit and stating that passport is not available, bail could be granted. This Court had granted bail to the applicant on 13/10/2020 on more than one condition including the condition that he shall deposit his passport with the Trial Court.

On affidavit, the applicant has stated that he does not have any passport. Accordingly, order dated 13/10/2020 is modified in the manner that condition

with regard to deposit of passport is omitted. Learned Trial Court shall accept the bail bonds furnished by the applicant without any further loss of time. This CrMP for modification is accordingly disposed off. Sd/- ( Manindra Mohan Shrivastava ) Judge Deepti
