Versus

1. The State Of Chhattisgarh Through The Secretary, Department Of (Finance) Treasury, Accounts And Pension, New Mantralaya, Indrawati Bhawan, Block - 1, First Floor, New Raipur, Civil And Revenue District - Raipur, Chhattisgarh

2. The Joint Director, Office Of Divisional Joint Director Treasury, Accounts And Pension, Bilaspur Division, Chhattisgarh ---- Respondents For Petitioner :

Mr. Rajesh Roshan Singh, Advocate For State :

Ms. Akanksha Jain, Dy. Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 26.11.2020

1. The issue involved in the present writ petition is the claim for compassionate appointment by the petitioner on the death of her husband.

2. The petitioner being the widow of the deceased employee had moved an application for compassionate appointment. After continuous correspondence between the petitioner and the department and inter se within the office of the respondents, finally the respondents vide

Annexure P-5 dated 04.06.2020 asked the petitioner to produce the succession certificate establishing herself to be the legal heir of the deceased employee.

3. Given the said document of the respondents dated 04.06.2020, it appears that the respondents have still kept the claim of the petitioner alive and have asked the petitioner now to produce a succession certificate establishing her to be the legal heir of the deceased employee for proceeding further with the claim of the petitioner for compassionate appointment.

4. Given the said facts, this Court is of the opinion that the writ petition itself at this juncture can be disposed of directing the petitioner to approach the concerned Court for getting the succession certificate at the earliest. The respondents are further directed that upon furnishing succession certificate by the petitioner her claim for compassionate appointment should be processed for finalization at the earliest preferably within 90 days from the date of receipt of succession certificate, particularly taking note of the fact that the husband of the petitioner died in the year 2011 and a considerable period of time has already lapsed.

5. With the aforesaid observation, the writ petition stands disposed of. Sd/- P. Sam Koshy Judge Khatai
