(2) Learned counsel appearing for the petitioner submits that the departmental enquiry pending against the petitioner and he has been superannuated from his post and, as such, his pension and further retiral dues could not be paid on account of pendency of departmental enquiry, therefore, a direction may be issued to respondent No.2 to dispose of the pending departmental enquiry expeditiously as the petitioner is retired person.
(3) Shri Y.S. Thakur, Deputy Advocate General appearing for the State/respondent No.1 submits that the prayer appears to be fair and reasonable.
(4) Accordingly, respondent No.2 is directed to dispose of the pending departmental enquiry pending against the petitioner in accordance with law within a period of five months from the date of receipt of copy of this order.
(5) With the aforesaid direction, the petition stands finally disposed of.
