Hon'ble The Chief Justice Hon'ble Shri Justice P. Sam Koshy Judgment on Board Per Navin Sinha, Chief Justice 1/10/2015 The present appeal arises from order dated 14.8.2015 dismissing W.P. (S) No.2956/2015. The Learned Single Judge held that no male candidate had been appointed against the post reserved for Scheduled Caste (Women) category and those appointed in that category had higher marks than the Appellant as also Respondents No.3 & 4 appointed in the Scheduled Caste category also had higher marks than the Appellant. 2.
Learned Counsel for the Appellant submitted that Jageshwari Tandan was a candidate in the Scheduled Caste (Physically Handicapped) category. There was no justification to transfer her to one of the two posts for
Scheduled Caste (Women) category.

We put a simple question to the Learned Counsel for the Appellant if any specific pleading had been made in the writ application that Jageshwari Tandan was a candidate in the Scheduled Caste (Physically Handicapped) category. It was very fairly acknowledged that there was no such pleading in support of this fact.

The Appellant was in the wait list category of Scheduled Caste (Women). It is not her case that any person with lesser marks than her in that category has been appointed.

We find not reason to interfere with the order under appeal. 6.
The appeal is dismissed.
