1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.139 of 2020, registered at Police Station Basantpur, District-BalrampurRamanujganj C.G., for the offence punishable under Section 450, 376 of the I.P.C.

2. Case of the prosecution, in brief, is that applicant has committed forcible sexual intercourse with the prosecutrix in

MCRC No. 7709 of 2020 the evening of 11.09.2020 for which the FIR was lodged on 14.09.2020, when husband of the prosecutrix returned and the incident was discussed with Sarpanch and other villagers.

3. Learned State counsel would oppose the prayer for grant of bail.

4. Considering the nature of allegation, I am not inclined to release the applicant on bail at this stage. Accordingly, the bail application is rejected. However, liberty is reserved in favour of the applicant to revive the prayer after examination of the prosecutrix.
