1. Learned counsel for the petitioner would submit that the departmental enquiry initiated against the petitioner is pending since April, 2010, therefore, a direction may be issued to respondent No.1 to conclude the Departmental Enquiry at the earliest.
2. Petitioner is working as Lecturer in the Government High School, Jharna, Block, Baikunthpur. On 24.04.2010 a charge-sheet was issued against the petitioner and a Departmental Enquiry was constituted.
3. According to the petitioner, the enquiry has already been completed,
however, final order has not yet been passed.
4. Considering the entire facts situation of the case, particularly for the reason that the Departmental Enquiry should not be kept pending for indefinite period, the writ petition is disposed of with a direction to respondent No.1 to decide and pass final order in the Departmental Enquiry at the earliest, preferably within a period of three months from the date of submission of certified copy of this order before the competent authority.
5. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
