Hon'ble Shri Justice P. Sam Koshy Order On Board 13.08.2018 The relief sought for by the petitioner in the instant petition is for a direction to the respondents to grant pensionary benefits to the petitioner from the date of his retirement.

Record shows that the petitioner was initially appointed on daily wage in the year 1981 and due course of time, the services of the petitioner were regularized on 03.09.2008 and the petitioner finally stood
superannuated on 28.02.2018. Though the petitioner has retired about 6 months ago, the respondents have till date not finalized the pension of the petitioner nor has he been given any pensionary benefits. 3.
Given the nature of dispute, this Court is of the opinion that let respondent no.2 take a decision in the case of the petitioner as to whether he is entitled for pensionary benefits or not and an appropriate decision be passed within a period of 60 days from the date of receipt of certified copy of this order. The petitioner in addition to the representation that he has already made would also be entitled to make a fresh representation within a period of 15 days from today and the respondents shall decide the same within the time specified above.
