1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.34 of 2020, registered at Police Station Tikrapara, Raipur, District-Raipur C.G., for the offence punishable under Sections 307, 302, 34 of the I.P.C.

2. As per the prosecution case, the present applicant along with Akash Nayak and Alok Mahanand has committed

MCRC No. 7667 of 2020 murder of deceased Abdul Khalid @ Baba at about 10:30am on 18.01.2020. The incident has been witnessed by Sheikh Danish, Sheikh Shahrukh, Ms. Babita Sonwani, Moinuddin Shah and Shahbaz Hussain.

3. Learned State counsel would read over the statements of eye witnesses.

4. Considering the material available in the case diary, I am not inclined to release the applicant on bail at his stage.

5. Accordingly, the bail application is rejected. However, liberty is reserved in favour of the applicant to revive the prayer after examination of the eye witnesses.
