Sam Koshy Order On Board 05.05.2017 The present application under Section 438 of Cr.P.C. has been filed seeking for grant of anticipatory bail to the applicant apprehending his arrest in connection with Crime No.490/2016 registered at P.S. Janjgir, District JanjgirChampa (CG) for the offence punishable under Section 376 of IPC. The allegation against the present applicant is that in the night of 12.12.2015, the applicant is said to have entered into the house of the prosecutrix and made physical relationship with her on the pretext of marriage. The applicant is said to have continued physical relationship with the prosecutrix for quite sometime and thereafter, he refused to marry her. Taking into consideration the nature of allegation levelled against the applicant, this Court is of the opinion that it is not a fit case where the applicant can be given the advantage of anticipatory bail. Accordingly, the instant application filed under Section 438 Cr.P.C. stands rejected.
